HUD released Section 8 Renewal Policy revisions dated December 12, 2006. An explanation of changes is included with the revised pages. Click on the link below to access the Renewal Policy revisions. NOTE: A significant clarification has been made in Chapter Six, for renewal of Section 8 contracts under Option 4. Under the new guidance, the "lesser of" test applies to each contract renewal, which includes Initial and Subsequent renewals. The "lesser of" test continues not to apply during Amend Rent Only years for multiyear HAP Contracts. Per guidance from HUD Headquarters, the policy is effective April 19, 2007. An owner selecting Option 4 and submitting the renewal package on or before April 19, 2007 is exempted from the "lesser of" test for Subsequent Renewals. The exception to this principle is the owner submitting a subsequent renewal package earlier than 120 days before the contract expiration date, for example 200 days, to avoid the "lesser of" test. Notice PIH 2006-23 (VAWA) - The Violence Against Women Act (VAWA) was signed into law in January 2006. VAWA applies to residents of public housing and Section 8 multifamily housing programs. Among other things, it prohibits the removal of subsidy assistance and eviction of Section 8 residents if the grounds for taking the action is an instance of domestic violence, dating violence, sexual assault or stalking. HUD has issued a Notice (PIH 2006-23) regarding implementation of VAWA, and additional Guidance in PIH 2006-42 which includes information on a newly issued Certification Form. The following forms from Handbook 4350.3, REV-1, Occupancy Requirements of Subsidized Multifamily Housing Programs, have now been assinged HUD form numbers, OMB approval and/or OMB expiration dates. There are no changes to the language in any of the forms.

Effective Date: O/As must begin using the new HUD Model Leases for all new admissions immediately and for existing tenants beginning with annual recertifications effective January 1, 2009, or later. Because forms that have OMB approval and OMB expiration dates cannot be modified, O/As who have lease modifications will need to develop lease addendums to incorporate the lease modifications. O/As who have had lease modifications approved by HUD or the Contract Administrator do not have to have the lease modifications included on the lease addendums approved again prior to implementation. Only if the O/A has obtained approval from HUD or the Contract Administrator to incorporate additional lease modifications must the O/A provide notice to the tenants in accordance with Chapter 6, Paragraph 6-12 of Handbook 4350.3 REV-1.
